[1/2] The seal of the U.S. Securities and Exchange Commission (SEC) is seen at their headquarters in Washington, D.C., U.S., May 12, 2021. At issue are proposed rules that would, among other things, require greater disclosures of large security-based swap positions. "The SEC is unlawfully withholding ... information to which Elliott is entitled and for which no valid disclosure exemption applies or has been properly asserted," Elliott said. In June, the regulator strengthened rules intended to prevent anyone in the security-based swaps market from manipulating prices. REUTERS/Yoshiyasu Shida/File Photo Acquire Licensing RightsOct 30 (Reuters) - Western Digital (WDC.O) said on Monday it would split itself into two companies that would focus on the hard drive and flash memory markets, days after talks of a merger with Japan's Kioxia stalled. Western Digital shares were up nearly 10% before the bell. The company launched a review of alternatives last year after activist investor Elliott Management disclosed a stake of nearly $1 billion in Western Digital and pushed it to separate those businesses. Reports last week said merger talks between Western Digital and Japan's Kioxia Holdings had stalled as opposition from Kioxia investor SK Hynix (000660.KS) complicated the on-again, off-again deal.

CROs work with drug companies through all stages of the drug development process, from drug discovery and preclinical development to Phase I through IV post-approval work. With a material portion of that outsourced, the CRO industry has grown accordingly. So, there are strong secular tailwinds driving growth for the CRO industry, but to be a successful contract research organization, it helps to have global scale. This comes as deep-pocketed investors — from top U.S. private equity and venture capital firms to global rivals like sovereign wealth funds — have intensified competition. Meanwhile, more than one-third of the clubs in the so-called "Big Five" leagues in Europe are backed by U.S. investors, including private equity and venture capital firms. "These recent transactions have set a precedent in terms of club valuation but also prompted many owners to consider selling to [private equity]," according to an analyst report from PitchBook. Some firms, like Sixth Street Partners, have found different outlets into taking a stake in European soccer, particularly in Spain's LaLiga. The shift is happening as soccer clubs have been looking for fresh capital following the distress stemming from the earlier days of the Covid pandemic.

With the stock market deeply oversold this week, we put cash to work by picking stocks across a range of sectors including energy, technology and materials. With the market oversold, per the S & P 500 Short Range Oscillator , our investment discipline called for us to search for any dislocations within the portfolio. Tech stocks remained under pressure Tuesday afternoon, giving us an opportunity to buy 7 shares of Broadcom and lower our cost basis. But stocks returned to the red Thursday, and the market remained firmly in oversold territory. However, the market reversed course in midday trading, with all three major U.S. stock benchmarks trading sharply higher.

Apple might be headquartered in Cupertino but its heart is in China. AdvertisementAdvertisementApple's leadership may operate from the 175-acre, tree-covered campus in sunny Cupertino, California but, in reality, the company's center of gravity is in China. Roughly 95% of Apple products including iPhones, AirPods, Macs and iPads are reported to be made in China . And multiple media outlets reported that China had banned iPhones for government staffers, knocking its share price. Apple CEO Tim Cook likes to present the company's decades-long involvement with China as a cause for celebration.

A potentially significant catalyst for Constellation Brands (STZ) stock is just a few weeks away, CNBC's Jim Cramer said Friday. "Elliott obviously… wants their stock higher," Cramer said on "Squawk on the Street." Elliott has "the ability to suggest things including perhaps maybe getting rid of some of the disappointing spirits business," said Cramer. The beer portfolio led by Modelo saw 11.8% year-over-year sales growth, while its wine-and-spirits division saw a 14% drop in revenue on an annual basis. The wine-and-spirits division has been a known weak spot for some time now, and Cramer has been advocating that Constellation sell it.

Lots of Wall Street firms are getting out ahead of this week's earnings from Constellation Brands (STZ) with price target increases. At the time, we were optimistic and increased our price target on the Modelo and Corona maker to $270 per share from $260. When measuring beer growth, he assesses how much shelf space companies get every year and how quickly those products fly off the shelves. All these factors "drive solid beer growth even as the macro environment gets worse," Falorni said. Wedbush also thinks Constellation will be able to weather those macro consumer storms and continue to drive earnings and revenue growth.

WASHINGTON — Senate Judiciary Committee Chairman Dick Durbin called on the Supreme Court to create a code of conduct as its new term begins Monday. Durbin for about a dozen years has, without success, asked the Supreme Court to adopt an enforceable code of conduct. Supreme Court justices are the only federal judges who are exempt from the official ethics rules. The Supreme Court has been under scrutiny this year because of media reports about justices receiving luxury travel, gifts, and other benefits. Durbin earlier this year asked Chief Justice John Roberts to appear before the Judiciary Committee to discuss Supreme Court ethics after the articles were first published.

After the September meeting pause last week, the target range for the fed funds rate remained at 5.25% to 5.50%. First, I don't know a soul besides me who agrees with that 20-year versus fed funds rate yield prognosis. They think the fed funds rate will come down or the 20-year yield is already extended. REUTERS/Androniki Christodoulou/File Photo Acquire Licensing RightsTOKYO, Sept 15 (Reuters) - Toshiba's (6502.T) largest shareholder Effissimo Capital Management has decided to tender its 9.9% stake in the $14 billion takeover offer by Japan Industrial Partners (JIP), a source said on Friday, raising the odds of the bid succeeding. The offer, which will end on Sept. 20, needs at least two-thirds of shareholders to tender their shares for it to succeed. Other major shareholders, Elliott Management and Farallon Capital Management, both have their executives on Toshiba's board which has unanimously approved the JIP takeover. Singapore-based fund 3D Investment Partners, previously Toshiba's second-largest shareholder, revealed in a filing in March that it had cut its stake to 4.90% from 7.20%.
